On 17 March 2022, the Minister of Immigration announced changes to the Employer Nomination Scheme (‘ENS’) subclass 186, that will now allow certain subclass 482 and 457 visa holders in Australia, working in occupations on the Short Term Occupation List, to apply for permanent residency.
PREVIOUS ARRANGEMENT
Previously, only 482 visa holders working in occupation on the Medium and Long Term list had a pathway to apply for permanent residence under the subclass 186 ENS migration program.
Meanwhile, short-term stream Temporary Skilled Shortage (‘TSS’) visa holders were only permitted to stay temporarily in Australia without a pathway to permanent residency. Some examples of occupations under the short-term stream include:
- Cooks
- Café and Restaurant Managers
- Sales and Marketing Managers
- Finance Managers
- Retail Pharmacists
WHO WILL BENEFIT FROM THE CHANGES!
If you hold a subclass 457 or 482 visa and working in an occupation on the Short Term Occupation List, you may be able to apply for permanent residence under the 186 ENS migration program.
Only limited details have been released, however if you hold a 482 visa, and have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021, and are currently employed in Australia, the changes may apply to you!
Most changes are due to come into effect 1 July 2022. But for 457 visa holders, these changes come into effect immediately!
